Article 4 Direction: Houses in Multiple Occupation

In April 2010, the legislation was changed so that, for the first time, small HMOs (ie accommodating 3 or more unrelated people) were brought into the range of developments requiring planning permission.  A draft Supplementary Planning Document (SPD) addressing the issue of Houses in Multiple Occupation (HMOs) in the City of Canterbury was then prepared.  The consultation on the SPD ended on Friday 29th October and we are currently considering the comments.

However, a further change in the planning legislation relating to HMOs,meant that changes of use from residential (Class C3) to HMOs (Class C4) would become “permitted development” (i.e. would once again not require planning permission). The change in legislation took effect from 1st October 2010.

In response to this change in the legislation the Council has made a draft Article 4 Direction related to Housing in Multiple Occupation. This would enable the final version of the Council’s Balanced Housing Provision Supplementary Planning Document to be applied in due course. It is the intention that the Article 4 Direction would be implemented not less than 12 months after the date of the public notice (2nd December 2010) attached in the supporting documents list below.

The Council has now finished consulting on the making of this Article 4 Direction related to Housing In Multiple Occupation.
